1) Acceptance of Terms

By accessing or using the Site, you agree to these Terms of Use (“Terms”), our Privacy Policy, and our Cookie Policy. If you do not agree, do not use the Site.

2) Who We Are; No Brokerage/Agency Relationship

READCorp d/b/a New Homes For Rent, LLC operates an online listings and information platform. We are not a landlord, lender, insurer, or property manager and are not a party to lease transactions between renters and property owners/managers. Listing information is provided by third parties and may change without notice.
Brokerage Disclosure: The Site is operated under the Florida real estate broker license of James William Banford (BK695005). Nothing in these Terms creates a brokerage/agency relationship with any user unless expressly agreed in a separate written agreement.

3) Eligibility; Accounts

You must be at least 18 years old to use the Site. You are responsible for safeguarding your credentials and all activity under your account. Notify us promptly of any unauthorized use.

4) Permitted Use; Prohibited Conduct

Use the Site only for lawful purposes and consistent with Fair Housing and anti‑discrimination laws. You agree not to:

• Post, submit, or facilitate discriminatory content or targeting;
• Scrape, harvest, crawl, or index Site content or data via automated means without our prior written consent;
• Circumvent access or rate‑limit controls; introduce malware; probe, scan, or test vulnerabilities; or interfere with Site operations;
• Misrepresent your identity or affiliation; post false, misleading, or deceptive content;
• Use Site content to make tenant‑screening decisions except through compliant third‑party screening providers;
• Copy, reproduce, modify, distribute, or create derivative works from the Site or its content except as expressly permitted.

5) Listings, User Content, and License

If you submit listings, photos, descriptions, reviews, or other content (“User Content”), you grant us a non‑exclusive, worldwide, royalty‑free, sublicensable license to host, store, display, reproduce, modify for formatting, distribute, and promote the Site in connection with your content. You represent that you have all necessary rights; that your content is accurate and lawful; and that it does not infringe third‑party rights or violate law.

6) Fair Housing

All advertising and listings must comply with the Fair Housing Act and applicable state/local laws. We may remove content or suspend access for violations.

7) Third‑Party Services

The Site may link to or embed third‑party services (e.g., mapping, analytics, forms, communications, application/screening portals). Those services are governed by their own terms and policies. We are not responsible for third‑party websites or terms.

8) Communications; E‑Sign; SMS

By providing your contact information, you consent to receive communications related to your account/inquiries (e.g., listing alerts, tour confirmations). Marketing messages require your consent where required by law, and you may opt out at any time.
SMS Terms: Message and data rates may apply. Reply STOP to cancel, HELP for help. Consent is not a condition of using the Site. Certain calls may be recorded for quality assurance where permitted by law and with appropriate notice.

9) Intellectual Property

All Site content (excluding User Content) is owned by us or our licensors and protected by IP laws. You may not reproduce or redistribute the Site content except as expressly permitted.

10) Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF ACCURACY, FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, NON‑INFRINGEMENT, AND AVAILABILITY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR‑FREE.

11) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SITE WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US (IF ANY) IN THE 12 MONTHS PRECEDING THE CLAIM.

12) Indemnification

You agree to indemnify and hold harmless READCorp d/b/a New Homes For Rent, LLC and our affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Site, your User Content, or your violation of these Terms.

13) DMCA Notice and Takedown

If you believe that content on the Site infringes your copyright, please send a notice to our DMCA Agent at cotyevans@thereadcorp.com with: (1) your contact information; (2) identification of the copyrighted work; (3) identification of the allegedly infringing material and its location; (4) a statement of good‑faith belief; (5) a statement under penalty of perjury that the notice is accurate and that you are authorized to act; and (6) your signature. We may remove content and terminate repeat infringers. Counter‑notices will be processed as required by law.

14) Governing Law; Arbitration; Class‑Action Waiver

These Terms are governed by the laws of the State of Delaware (without regard to conflict‑of‑law principles).
Binding Arbitration: Except for small‑claims matters or injunctive relief for IP or misuse of the Site, any dispute will be resolved by individual, confidential arbitration in Wilmington, Delaware, administered by JAMS or AAA (as mutually agreed) under their applicable rules.
No Class Actions / Jury Trial Waiver: You and we waive any right to a jury trial or to participate in a class or representative action.
Opt‑Out: You may opt out of this arbitration clause within 30 days of first use by emailing cotyevans@thereadcorp.com with subject “Arbitration Opt‑Out” and your name and contact details.

15) International Use; Export Controls

The Site is controlled from the United States. If you access it from elsewhere, you are responsible for compliance with local laws and export controls.

16) Suspension; Termination; Changes

We may suspend or terminate access to the Site at any time for any reason. We may update these Terms periodically; updates are effective upon posting. Your continued use constitutes acceptance.

17) Miscellaneous

• Severability: If any provision is unlawful or unenforceable, the remaining provisions remain in effect.
• No Waiver: Failure to enforce a provision is not a waiver.
• Assignment: You may not assign these Terms without our consent. We may assign them in connection with a corporate transaction.
• Entire Agreement: These Terms, along with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and us regarding the Site.
